GAUTENG NATURE CONSERVATION BILL
The above matter has reference.
In March 2011, the Gauteng Provincial Executive approved the Policy Proposal for the drafting of a Nature
Conservation Act for the Gauteng Province.
The new Act will seek to:
a. align provincial legislation with the provisions of the Constitution of the Republic of South
Africa, 1996 particularly section 33 (the right to just administrative action) and the Promotion of
Adminstrative Justice Act, 2000.
b. align provincial legislation to national environmental legislation such as the National
Environmental Management Act, 1998 and the National Environmental: Biodiversity Act, 2004
and strengthen national legislation.
c. remove certain provisions from the current Nature Conservation Ordinance, 1983 that are now
catered for in national legislation to avoid duplication of functions between national and
d. remove provisions in the Nature Conservation Ordinance, 1983 (Ordinance) that are now
e. align enforcement provisions in particular penalties with current environmental trends.
f. provide for Gauteng specific nature conservation issues that are not addressed in National
legislation and/or were previously excluded in the Ordinance.
The drafting of the Bill commenced in July 2011 and was completed in March 2012. Your Association has
been identified as an important Stakeholder of the Department. In view of this the Department would like to
